Noise complaints in Harrow: there is no night service

The first thing to know about reporting noise in Harrow is what the council cannot do, and it says so in its own words: it does not provide an out-of-hours noise service, and one-off issues such as shop alarms or parties cannot be dealt with at night.

That is worth stating plainly because several neighbouring boroughs do run a night noise team, and residents reasonably assume Harrow does too. The service here is built around persistent, repeating noise rather than a single bad night.

What you have to do first

A complaint must be accompanied by a completed fourteen-day noise diary, which the council publishes as a form. An officer reviews the report within five working days.

For anything to follow, an officer must then witness the nuisance from your property. Harrow describes this as a legal requirement, and it is: a statutory nuisance has to be established by the council’s own assessment, not by the complainant’s account of it.

The permitted hours

Construction noise is permitted Monday to Friday from 8am to 6pm and on Saturdays from 8am to 1pm. No noisy work is allowed on Sundays or bank holidays. DIY, including drilling and hammering, should not start before 8am or continue after 8pm.

Fireworks may not be let off between 11pm and 7am, with exceptions to 1am for Chinese New Year, Diwali and New Year’s Eve, and to midnight on 5 November. An under-18 with fireworks in a public place, or anyone letting them off after 11pm, faces an £80 fixed penalty.

What the council can eventually do

If a statutory nuisance is established, the council must serve an abatement notice specifying what has to stop and by when. For noise there is a seven-day informal route first: the council may try persuasion, and must serve a notice if the nuisance continues after seven days. The recipient can appeal to a magistrates’ court within twenty-one days.

The defence of "best practicable means" is available to industrial, trade and business premises. It is not available for domestic noise.

On penalties, Harrow’s website states fines of up to £5,000 for domestic cases and £20,000 for commercial. The legislation those figures come from was amended in 2015 and no longer caps them — a breach of an abatement notice now carries an unlimited fine. Treat the council’s figures as its own published position rather than the current legal maximum.

Licensed premises are a different route

Noise from a pub, bar or club goes to the licensing team, not environmental health, and only four grounds are admissible: crime and disorder, public safety, public nuisance, and harm to children. Unlike a planning objection, your name and address may be disclosed to the licence holder unless you ask for privacy. Residents can also apply for a licence review, and the committee can warn, add conditions, suspend or revoke.
